MANILA, Philippines — Pinasasagot ng Korte Suprema si Vice President Sara Duterte at ilang abogado sa inihaing apela ng Kamara laban sa naging desisyon sa impeachment na unconstitutional.
Binigyan ng 10 araw na ‘non-extendible” period sina Duterte, Atty. Israelito Torreon at iba pang abogado kaugnay sa motion for reconsideration ng House of Representatives, na humihiling na baligtarin ang desisyon na nagbasura sa impeachment case ni Duterte.
Ang kahilingan ay nagsasaad na payagan silang gampanan ang ekslusibong tungkulin na usigin ang isang impeachable official at ang Senado na litisin ang kaso.
“The House asks this Honorable Court not to stand with a certain political faction or another, but to uphold the Constitution, which gives life to all the institutions of government, and with the people, who in turn, are the true sovereign, and to whom all accountability, trust, and power, are owed. Wherefore, premises considered, Respondents respectfully pray that the Honorable Court reverse the immediately executory nature of its July 25, 2025 Decision, and, after due proceedings, reconsider the same and dismiss the Petitions, for lack of merit,” bahagi ng MR.
Nauna nang idineklara ng SC na ang Articles of Impeachment laban kay Duterte ay pinagbabawalan sa ilalim ng one-year bar rule ng Article XI, Section 3(5) ng Konstitusyon.
Samantala, muling iginiit ng SC na ang desisyon ay “immediately executory”
